Abstract
This is a ruling in respect of an application brought by the applicant Mbeya Cement Company (henceforth "the applicant") seeking the indulgence of this court to set aside the dismissal order it made on 06.02.2014.The background facts of this matter were sufficiently set out by this court in its ruling which was handed down on 02.04.2015 in respect of a preliminary objection raised by Mr. Mwambene, learned counsel for the respondent Kundah Singh Construction (henceforth "the respondent''). I shall recite the said background facts as they are equally relevant in this ruling
