It arises from the decision of the High Court of Tanzania at Moshi (Jundu, J. as he then was) upholding the District Court of Moshi (Kabwe, RM.) in which the appellant was convicted of rape contrary to section 130(1) of the Penal Code, as amended, and sentenced to thirty years imprisonment.
